POSSIBILITY OF OBTAINING GEOGRAPHICAL INDICATION REGISTRATION FOR RENDA DE ABROLHOS OF CORONEL XAVIER CHAVES - MG

Resumo

Geographical Indication (GI) is a form of protection, within the context of industrial property, for products or services that originate from a certain location, and can occur in two different ways: Denomination of Origin (DO) or Indication of Origin (IP). This work aims to assess the possibility of obtaining GI registration with the National Institute of Industrial Property (INPI), for the Renda de Abrolhos (Abrolhos weft) in the municipality of Coronel Xavier Chaves-MG, considering the requirements of current legislation. For this, applied qualitative research was conducted, using bibliographical and documental research, along action research as methodological procedures. The potential for meeting some of the legislation's requirements was analyzed by collecting documents to prove the existence of the procedural substitute, the notoriety of the geographical name, the preparation of a proposal for a draft technical specification booklet and the delimitation of the geographical area of production, showing that there is evidence that makes it possible to apply for a GI registration at the INPI, for the IP type, considering the main current legislation requirements. However, the decision to request the GI must be taken together with other stakeholders operating within the territory, so joint strategies for the production, commercialization and dissemination of the Renda de Abrolhos can be developed and contribute to local development.
